(Road Traffic Act s 61)

  • Driving a motor vehicle in a manner (which expression includes speed) that is, having regard to all the circumstances of the case, dangerous to the public or to any person
    • What is ‘dangerous to the public or to any person’ is a subjective consideration and must be assessed with reference to the particular facts of every charge. As such, we may be able to negotiate with Police to downgrade your charge.
    • You will be considered to be dangerously driving if you are driving while impaired by alcohol or drugs to the extent that you are incapable of maintaining control over the vehicle
  • There are a range of penalties available for the Court to impose on dangerous driving offenders. These include fines, driver’s licence disqualification and a term of imprisonment.
