Fraud offences
- Dishonestly inducing the owner of property to part ways with the property, or
- Dishonestly dealing with the property of another, or
- Dishonestly inducing another person to use their property in a certain way
The offence carries a maximum penalty of 7 years’ imprisonment, or 10 years if the person deceived is 60 years of age or older
The offence may be dealt with summarily if the benefit gained or property that was obtained amounts to $50,000 or less
- Offence is deemed less serious and will be tried in the Magistrates Court, and will likely result in a less severe penalty
It is immaterial that the accused intended to give value for the property: Code s 409(3)
